Terms of Service
Effective Date: April 21, 2026
Welcome to Tejay Visuals (“Tejay Visuals,” “we,” “our,” or “us”). By booking or using our photography, videography, livestream, editing, or related creative services, you (“Client”) agree to be bound by these Terms of Service.
1. Services
Tejay Visuals provides professional photography, videography, livestream production, editing, content creation, and related creative services. The scope of services for each project will be agreed upon before the session or event.
2. Booking and Payment
A booking is confirmed once any required retainer or deposit has been received.
Unless otherwise agreed in writing, the remaining balance is due on or before the scheduled session or event date.
Failure to make payment may result in cancellation of services or withholding of final deliverables until payment has been received in full.
3. Cancellations and Rescheduling
Deposits or retainers are non-refundable except where Tejay Visuals is unable to provide the agreed services.
Rescheduling requests are subject to availability and must be approved by Tejay Visuals.
If Tejay Visuals is unavailable on the requested rescheduled date, the original booking shall be treated as cancelled.
4. Delivery of Media
Final photographs and videos will be delivered digitally unless otherwise agreed.
Estimated delivery times are provided as a guideline and may vary depending on editing workload, project size, or unforeseen circumstances.
5. Artistic Style
The Client acknowledges that they have reviewed the Tejay Visuals portfolio and understands the artistic style, editing techniques, color grading, composition, lighting, posing, and overall creative approach used by Tejay Visuals.
Creative decisions are made at the sole discretion of Tejay Visuals.
6. Client Responsibilities
The Client is responsible for:
Tejay Visuals is not responsible for missed images resulting from lateness, venue restrictions, weather, uncooperative participants, or circumstances outside our reasonable control.
7. Portfolio, Copyright, and Promotional Use
All photographs, videos, digital files, and other creative works produced by Tejay Visuals remain the exclusive intellectual property and copyright of Tejay Visuals unless otherwise agreed in writing.
By booking or using the services of Tejay Visuals, the Client grants Tejay Visuals and its representatives the irrevocable, perpetual, worldwide, royalty-free right and permission to use, reproduce, publish, display, distribute, edit, and promote photographs and videos captured during the session or event for lawful business purposes, including but not limited to portfolio display, advertising, marketing, social media, the Tejay Visuals website, online galleries, printed promotional materials, competitions, exhibitions, and educational presentations.
Unless a separate written agreement signed by both parties before the session or event expressly provides otherwise, the Client acknowledges and agrees that Tejay Visuals may publicly display and use photographs and videos from the session or event for promotional purposes without further notice or compensation.
Any request to restrict or prohibit promotional use must be submitted in writing and approved by Tejay Visuals before the session or event. No verbal request or request made after the session or event shall modify or revoke the rights granted under these Terms of Service unless Tejay Visuals expressly agrees in writing.
Nothing in these Terms of Service limits any rights or obligations required under applicable law.
8. Client Use of Delivered Media
The Client receives a non-exclusive, non-transferable license to use the delivered photographs and videos for personal use unless otherwise agreed in writing.
The Client may not sell, sublicense, commercially exploit, or substantially alter the work without the prior written permission of Tejay Visuals.
9. Equipment Failure and Force Majeure
Tejay Visuals shall not be liable for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, illness, accidents, venue restrictions, internet outages, government actions, equipment malfunction despite reasonable precautions, or other unforeseen events.
In such circumstances, liability shall be limited to the amount paid by the Client for the affected services.
10. Limitation of Liability
Tejay Visuals will exercise reasonable care in performing all services.
To the maximum extent permitted by law, Tejay Visuals shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services or deliverables.
11. Website Content
All text, photographs, videos, graphics, logos, branding, and other content appearing on the Tejay Visuals website are the property of Tejay Visuals and may not be copied, reproduced, distributed, or used without prior written permission.
12. Privacy
The collection and use of personal information is governed by the Tejay Visuals Privacy Policy.
13. Amendments
Tejay Visuals reserves the right to update these Terms of Service at any time. Updated Terms become effective immediately upon publication on our website.
14. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
